  1. 依據花蓮縣政府109年7月9日府人訓字第1090128015號函辦理。
  2. 查公務員服務法(以下簡稱服務法)第14條第1項規定：「公務員除法令所規定外，不得兼任他項公職或業務。……」次查銓敘部101年8月21日、10月24日部法一字第1013634408 號、第1013657408號書函規定，技術士技能檢定作業及試場規則(以下簡稱試場規則)未明文規定公務員得兼任該術科測試辦理單位所擬聘請之監評人員，尚不得據以作為公務員得兼任監評人員之法令依據，以及中餐烹調職類丙級技術士技能檢定術科監評人員及衛生監評人員既屬「依法令從事於公務者」，故公務員除法令另有規定始得兼任該等職務外，尚不得以專家身分個人名義兼任之。復查銓敘部 108年11月25日部法一字第1084876512號函略以，經權責機關(構)認定為任務編組或臨時性需要所設置之職務，非屬服務法第14條所定公務員不得兼任他項公職或業務之情形。
  3. 茲教育部建議重行考量前開銓敘部101年8月21 日、10月24日書函解釋有無調整空間，案經銓敘部2度函詢勞動部意見並審慎衡酌後，因是類依職業訓練法、技術士技能檢定及發證辦法、試場規則等規定，取得監評人員資格並接受術科測試辦理單位遴聘擔任監評工作者，係屬前開銓敘部108年11月25日函所稱「經權責機關(構)認定為任務編組或臨時性需要所設置之職務」之情形，爰公務員兼任技能檢定之監評人員，當不受服務法第14條規定限制。銓敘部業以旨揭本(109)年7月2日令釋明，並停止適用前開銓敘部 101年8月21日及10月24日書函解釋在案。
