  1. 依據花蓮縣政府109年8月25日府人訓字第1090163224A號函辦理。
  2. 查公務員服務法(以下簡稱服務法)第14條之2及第14條之3 規定略以，公務員兼任非以營利為目的之事業或團體(以下 簡稱非營利團體)職務，無論是否受有報酬，均應經權責機 關許可。次查銓敘部本(109)年3月17日部法一字第 1094910822號書函略以，公務員兼任非營利團體之職務，除經該團體認定為任務編組或臨時性需要所設置，毋需經權責機關許可外，餘均應視是否受有報酬，分別依服務法第14條之2或第14條之3相關規定辦理。
  3. 有關公務員得否加入各類合作社成為社員並經選任為理 (監)事、社員代表，及其持股比例等疑義，經銓敘部通盤檢 討各類合作社之屬性並徵詢相關主管機關意見審慎研議 後，以依合作社法成立之合作社，除信用合作社具營利法 人性質外，餘均屬非以營利為目的之事業體，是依合作社法成立之合作社(除信用合作社外)，係服務法第14條之2及第14條之3所稱非營利團體，公務員兼任合作社(除信用合作社外)職務應依上開規定辦理；至認購社股限制部分，因與服務法規定無涉，爰應依合作社法相關規定辦理。又公務員雖得加入信用合作社成為社員並經選任為社員代表，惟其認股比例至多不得超過實收股金總額百分之五，且不得兼任信用合作社理事、監事、經理人、清算人、監管人等職務。
  4. 另銓敘部90年12月12日90法一字第2091802號書函規定，依臺灣省青果運銷合作社(以下簡稱青果合作社)章程規定之社 員及社員代表資格條件觀之，社員及社員代表應負共同運 銷之義務，為服務法第13條第1項所稱經營商業，公務員應 不得為之。茲以上開銓敘部90年12月12日書函所限制者，係 公務員擬加入青果合作社為社員或社員代表前，必須先符 合青果生產者或種植青果且願意參加共同運銷者之資格條 件，屬經營商業之範疇，自為服務法所不許，與青果合作 社組織屬性係服務法第14條之2及第14條之3所稱之非營利團體，洵屬二事。是青果合作社雖屬服務法第14條之2及第14條之3所稱之非營利團體，惟其入社資格已違反服務法第13條經商禁止之規定，公務員自無從經權責機關許可而加入青果合作社，併予敘明。
