  1. 依據花蓮縣政府109年9月23日府人訓字第1090187940號函辦理。
  2. 查司法院釋字第308號解釋文，公立學校聘任之教師不屬於公務員服務法（以下簡稱服務法）第24條所稱之公務員，惟兼任學校行政職務之教師，就其兼任之行政職務，則有 服務法之適用。爰公立學校兼任行政職務教師之兼職範圍 及許可程序等規範，應依服務法相關規定辦理。至未兼任 行政職務教師，則依教育人員任用條例、公立各級學校專 任教師兼職處理原則（以下簡稱教師兼職處理原則）及相 關函釋規定辦理，合先敘明。
  3. 依銓敘部109年8月18日部法一字第10949605492號函，依合作社法成立之合作社（除信用合作社外），係服務法第14條之2及第14條之3所稱「非以營利為目的之事業或團體」，爰公務員及公立學校兼任行政職務教師兼任合作社（除信用合作社外）職務，除經該社認定為任務編組或臨時性需要所設置者，毋需經權責機關許可外，餘均應依上開規定辦理；至認購社股限制部分，因與服務法規定無涉，爰應依合作社法相關規定辦理。又信用合作社具營利法人性質，故公務員及公立學校兼任行政職務教師雖得加入信用合作社成為社員並經選任為社員代表，惟其認股比例至多不得超過實收股金總額5％，且不得兼任信用合作社理事、監事、經理人、清算人、監管人等職務。
  4. 至未兼任行政職務教師擬兼任旨揭職務，亦應符合下列規定：
    1. 兼職範圍及職務：合作社之屬性（營利或非營利）及兼任職務，應符合教師兼職處理原則第4點及第5點規定。
    2. 核准程序：依教師兼職處理原則第10點規定，教師兼職應事先報經學校書面核准後始得前往。倘所兼任職務有提名選任之前置作業程序，則應視擬兼職之合作社屬性，決定是否於應邀提名選任該職務前即報經學校書面核准。惟如符合第10點第3項相關款次所列兼職態樣，則免報經學校核准。
    3. 認購社股限制部分，非屬信用合作社之合作社，依合作社法相關規定辦理，信用合作社之認股比例至多不得超過實收股金總額5％。
  5. 另，合作社入社資格條件係屬服務法第13條及教師兼職處理原則第3點所訂經營商業之範疇者，公務員及公立學校教師（含兼任行政職務）均不得加入該合作社。
