  • 依據花蓮縣政府109年12月7日府人訓字第1090240279號函辦理。
  • 銓敘部頃接民眾詢問公務人員於留職停薪期間得否執行銓敘部108年11月25日函所稱「領證職業」所為之事務，案經銓敘部審慎衡酌後，考量留職停薪人員雖仍具有公務人員身分，但已留職停薪，故不發生專心從事職務或身兼他職之問題，是公務人員依留職停薪辦法第4條第2款、第3款及第5條第1項第1款至第4款申請留職停薪者，係保留本職職缺於原辦公時間轉從事各該留職停薪事由，其留職停薪期間基於維持生計需求，得另從事非屬留職停薪事由之其他工作，業經銓敘部作成旨揭109年11月30日令釋，並停止適用銓敘部91年4月29日書函解釋在案。
  • 另公保被保險人辦理留職停薪者，已不具現職人員身分， 非屬公保法強制加保對象，應選擇於留職停薪期間退保， 或自付保險費繼續加保；一經選定後，不得變更。又被保 險人於留職停薪期間選擇繼續加保又同時參加其他職域社 會保險者，應自重複加保之日起60日內，申請溯自參加其 他職域社會保險之日起退保。未申請退保或逾限申請者， 其重複加保期間發生保險事故，不予給付；該段年資除公 保法另有規定外，亦不予採認；其所繳之保險費，不予退 還，附為敘明。
