教育部89年3月2日台(89)人(一)字第89019881號書函、98年10月22日台人(一)字第0980181484號函，自110年8月11日起停止適用。

 

  • 依據花蓮縣政府110年8月12日府教學字第1100161032號函轉教育部110年8月11日臺教授國字第1100084895號函辦理。
  • 查109年6月30日修正施行之教師法（以下簡稱本法），已刪除原教師法第14條第1項第7款「經合格醫師證明有精神病尚未痊癒」之規定。次查教育部97年5月27日台國（四）字第0970077340號函略以，學校辦理教師甄選時，有關教師應具之資格條件，以教育人員任用條例、師資培育法等相關法令已有規定，爰不宜再另定其他牴觸或違反相關法律之條件，以保障教師公平受聘之權利，且辦理公開甄選之目的即為經公平、公正、公開之程序為學校遴選最適任之教師，故學校辦理公開甄選臨聘教師時，除法定資格外，尚不得以教師之戶籍或限定身心障礙者報考等另為其他之限制。
  • 再查本法第10條第2項規定略以，教師續聘三次以上服務成績優良者，經教師評審委員會（以下簡稱教評會）全體委員三分之二以上審查通過後，得以長期聘任，其聘期由各校教評員會訂定之，至多七年。
  • 旨揭函文係就高級中等以下學校教師甄選簡章於報名者之身心健康情形另作限制及教評會審查教師長期聘任期間至離職等解釋，未合現行規定，應予停止適用。
