  • 依據花蓮縣政府110年8月16日府教特字第1100163517號函轉教育部110年8月13日臺教人(四)字第1100086893號函辦理。
  • 查107年7月1日施行之公立學校教職員退休資遣撫卹條例（以下簡稱退撫條例）第18條規定：「（第1項）教職員有下列情形之一者，應准其自願退休：一、任職滿5年，年滿60歲。……。（第3項）第1項第1款所定年滿60歲之年齡，對所任職務有體能上之限制者，中央主管機關得酌予降低。但不得少於55歲。……」
  • 復查特殊教育法第11條第1項規定：「高級中等以下各教育階段學校得設特殊教育班，其辦理方式如下：一、集中式特殊教育班。二、分散式資源班。三、巡迴輔導班。」第25條第1項規定：「各級主管機關或私人為辦理高級中等以下各教育階段之身心障礙學生教育，得設立特殊教育學校；特殊教育學校之設立，應以小班、小校為原則，並以招收重度及多重障礙學生為優先，各直轄市、縣（市）應至少設有一所特殊教育學校（分校或班），每校並得設置多個校區；特殊教育班之設立，應力求普及，符合社區化之精神。」
  • 考量特殊教育教師需照顧類別多元之身心障礙學生，面對學生突發狀況及情緒，需有良好體能、高度專注力、反應與機動能力，確須考量體能負荷之合宜範圍。爰規範自111年2月1日起，符合下列資格之公立高級中等以下學校特殊教育教師，依退撫條例第18條第1項第1款規定申請自願退休時，退休年齡得予調降：
    1. 認定標準：具備特殊教育學校（班）身心障礙組教師證書之專任教師（含兼任行政職務者），於特殊教育學校或一般學校特殊教育班（包括各類別特殊教育班）實際教授身心障礙學生，至其申請退休生效日已連續滿3年。惟兼任行政職務者，每週實際教授身心障礙學生之授課節數應達8節以上。
    2. 自願退休條件：任職滿5年，年滿56歲。
  • 另，公立高級中等以下學校特殊教育教師依前開規定申請自願退休，其月退休金起支年齡仍應依退撫條例第32條規定辦理，即除符合同條第5項情形者外，全額月退休金起支年齡為58歲，併敘。
