  • 依據花蓮縣政府110年9月7日府人訓字第1100179591號函轉銓敘部110年9月3日部法一字第11053810572號函辦理。
  • 本案所涉相關法規及解釋如下：
    1. 公務員服務法(以下簡稱服務法)第13條第1項規定：「公務員不得經營商業或投機事業。……」
    2. 銓敘部本(110)年8月18日部法一字第11053781671號令略以，公務員將個人肖像一次性授權他人使用獲致正常利益，且未掛名代言人或參與相關商業活動，非屬服務法第13條第1項經營商業之範疇，其經權責機關(構)以策略聯盟方式指派參與之相關商業活動者，亦同。肖像之授權不得概括授權予他人取得再授權利用之權利。
  • 茲以個人肖像授權之事務，除由本人為之外，尚得委任他人處理相關事宜，是為明確規範公務員個人肖像權合理使用範圍，經銓敘部審慎衡酌後，基於公務員身分性質與個人權利間之衡平，銓敘部本年8月18日令所稱「公務員將個人肖像一次性授權他人使用」，尚包括公務員委任自然人或法人處理其肖像授權事宜。惟上開授權仍應符合以一次性方式明定使用範圍及期間等要件授權他人使用，且未掛名代言人或參與相關商業活動；或係經權責機關(構)以策略聯盟方式指派參加後續商業活動，始與服務法第13條第1項規定無違，業經銓敘部作成旨揭銓敘部本年9月3日令釋補充規範。
