  • 依據花蓮縣政府110年11月10日府人福字第1100228318號函轉教育部110年11月9日臺教人(四)字第1100139537號書函辦理。
  • 查公立學校教職員退休資遣撫卹條例第47條規定：「（第1 項）支領或兼領月退休金教職員死亡而有下列情形之一 者，原服務學校得先行具領三個基數之遺屬一次金，辦理 其喪葬事宜：一、無合法之遺屬一次金領受遺族。……。 （第2項）前項用以辦理亡故退休教職員喪葬事宜之遺屬一 次金如有賸餘，依其退撫新制實施前、後審定年資之比率 計算，分別歸屬公庫及退撫基金。……。」同條例施行細 則第62條規定：「各學校依本條例第四十七條第一項規定 具領亡故退休教職員三個基數之遺屬一次金辦理喪葬事宜 時，應以學校名義為之。」
  • 復查銓敘部105年6月28日部退三字第1054121247號書函規 定略以，支領月退休金之公務人員亡故時，若已無合法之撫慰金領受遺族時，得由原服務機關先行具領3個基數之一次撫慰金辦理其喪葬事宜。亡故退休人員之喪葬事宜如確實由其非法定遺族辦理並支付費用，則該名非法定遺族得檢具相關證明文件向原服務機關辦理核銷，惟所申請之金額須以機關前開先行具領之3個基數一次撫慰金為限（按：一次撫慰金於公務人員退休資遣撫卹法施行後改稱遺屬一次金。）
  • 茲因公立學校教職員退休資遣撫卹條例與公務人員退休資 遣撫卹法，於亡故退休人員無合法之遺屬一次金領受遺族 時，得由服務機關或學校先行具領3個基數遺屬一次金辦理 喪葬事宜有相同規定，基於公教處理一致，本案所詢亡故 支領月退休金教師如無合法之遺屬一次金領受遺族，得比 照前開銓敘部105年6月28日書函規定，由實際辦理其喪葬 事宜之其他親屬（姪子），向原服務學校申請於上開3個基 數一次遺屬金額度內，檢據核銷喪葬費用。
