  • 依據花蓮縣政府111年4月27日府人任字第1110084671號函轉行政院人事行政總處111年4月25日總處組字第1112000509號書函辦理。
  • 查108年10月1日修正發布之約僱辦法第4條規定：「（第1 項）各機關首長不得僱用其配偶及三親等以內血親、姻親 為本機關之約僱人員；對於本機關各級主管之配偶及三親 等以內血親、姻親，在其主管單位中應迴避僱用。但在機 關首長或各級主管接任以前已訂立之僱用契約，不在此 限。（第2項）各機關首長於公務人員任用法第26條之1第1 項各款所定期間內，不得僱用約僱人員。（第3項）有公務 人員任用法第28條第1項第1款至第8款及第10款情事之一 者，不得僱用為約僱人員。（第4項）約僱人員於僱用後，發現其於僱用時有前3項所定不得僱用情事之一者，應即終止契約。約僱人員於僱用後，發生前項所定不得僱用之情事者，亦同。」
  • 茲以約僱契約為繼續性契約，各機關如發現約僱人員於僱用時或僱用後有約僱辦法第4條第1項至第3項所定不得僱用情事之一者，不宜以解除契約作為法律效果，同條第4項明定其法律效果為「終止契約」，其僱用關係自契約終止之日起向後失其效力。爰約僱人員僱用期間之職務行為，不失效力；業已依規定支付之報酬及其他給付，不予追還，前開法律效果業經108年10月1日約僱辦法修正說明敘明 （行政院108年10月1日院授人組字第10800446564號函諒達）。
  • 原行政院人事行政局100年2月15日局力字第1000017037號函、行政院人事行政總處106年9月21日總處組字第10600564941號函及歷次函釋，與約僱辦法第4條規定未合部分，自111年4月25日起停止適用。
