  • 依據花蓮縣政府111年10月17日府人福字第1110207693號函辦理。
  • 本案修正重點如下：
    1. 配合本法第七條修正增訂公務人員繳付公務人員退休撫卹基金之費用，不計入繳付年度薪資收入課稅之規定，明定不計入薪資收入課稅之適用範圍。（修正條文第七條之一）
    2. 增訂當事人無繼續任職意願時，服務機關得依其意願不進行命令退休之職業重建服務程序。（修正條文第十八條）
    3. 增訂平均俸（薪）額及減額月退休金於計算年數時，遇有畸零日數之計算方式。（修正條文第二十七條、第三十一條）
    4. 為符合本法第三十四條第三項所定本法公布施行前支領或兼領月退休金人員應發給一次補償金餘額之規定，刪除現行條文第三十三條第七項。（修正條文第三十三條）
    5. 配合公務員懲戒委員會更名為懲戒法院，將「公務員懲戒委員會」修正為「懲戒法院」。（修正條文第四十條、第四十五條及第五十五條）
    6. 本法第四十五條第四項所定遺族不得請領遺屬年金之限制範圍，增訂排除依勞工退休金條例請領月退休金者。（修正條文第五十九條）
    7. 配合本法第六十七條修正退休公務人員或遺族所領月退休金、月撫卹金或遺屬年金給付金額之調整機制，修正相關規定。（修正條文第 一百零三條）
    8. 參照司法院釋字第七百八十二號解釋意旨，修正本法第七十七條第一項第一款所定退休公務人員再任有給職務之適用範圍，刪除受委託行使公權力之團體、個人所僱用，或承攬政府業務之團體、個人所僱用之職務。（修正條文第一百零九條）
    9. 配合本法第七十七條刪除第一項第三款規定，刪除現行條文第一百十三條規定。（修正條文第一百十三條）
    10. 配合本法部分條文修正施行日期，明定本細則修正條文之施行日期。 （修正條文第一百三十一條）
