  • 依據花蓮縣政府113年9月5日府教學字第1130175025號函辦理。
  • 查本辦法第5條第3項規定：「前項留職停薪教師已於寒、暑假復職，又因同一事由申請於次學期開學後留職停薪者，應有不可預期之緊急情事；其認定有疑義時，得由服務學校編制內相關人員組成諮詢小組，提供意見作為核准之參考……。」第6條規定：「(第1項)留職停薪人員除其他法律另有規定外，應於留職停薪期間屆滿之次日復職。但其留職停薪期間屆滿前原因消滅後，應申請提前復職。……(第7項)依第1項、第3項及第4項提前復職或延長留職停薪者，應有不可預期之緊急情事；其認定有疑義時，得比照前條第3項規定程序辦理。」第11條規定：「(第2項)高級中等以下學校教師、運動教練、社會教育機構專業人員及學術研究機構之研究人員申請留職停薪之核准程序，由各主管教育行政機關定之。(第3項)前項核准程序，於教師有第5條第3項申請留職停薪或第6條第7項提前復職或延長留職停薪之情形者，應明定須報主管教育行政機關核准，或由服務之學校核准後報主管教育行政機關備查。」
  • 有關教師有本辦法第5條第3項申請留職停薪情形(已於寒暑假復職，又因同一事由申請於次學期開學後留職停薪)，教育部前以111年2月16日臺教授國字第1110017193A號函周知在案。依本辦法第6條第7項及第11條第3項規定，留職停薪教師申請提前復職，應有不可預期之緊急情事，且主管機關應明定是類案件之核准程序，學校並負有審酌留職停薪教師申請提前復職之「實際需求」、「留職停薪期間屆滿前提前復職理由」及「不可預期之緊急情事」是否屬實之責任，必要時得由學校組成諮詢小組，提供意見作為學校核准之參考並報主管機關核准，以落實相關機制。學校或主管機關於審核程序中，亦應確實檢視申請之事由是否與法規規範意旨相符，以兼顧學生受教權及教師權益。
